Now this I can get behind. Real estate brokers are making a killing off of the current market and their aggressive nature only adds fuel to the housing crisis. Their rates need to be contract based, not percent based.

You add in a broker, and they are looking for their commission too. The higher you pay, the better their commission. Avoiding the middle-man opens up opportunities for savings. I’ve tried purchasing with brokers vs buying direct, and I was surprised how much I saved by buying direct.

Dave, you are the perfect example of the dealer’s pry… they love people like you that always think they got the best deal while getting ripped off, the heimishe leasing companies do a fabulous job by delivering rock bottom prices to the community, and of course they make money doing that, they have to…

Joe, I respect the endeavor you guys are doing, but my experience with auto leasing and purchasing brokers hasn’t proved to be cheaper than working directly with the dealer or business. I have a paperwork trail to prove it. It’s possible that there are consumers who aren’t equipped to negotiate or “bargain” with the dealer may be better off working with an broker/agent, but the absolute best way to get a deal— is straight with the dealership. You know better than me, don’t think for a moment that a frum broker is always offering the ‘best and final’ to a client, simply because both parties are wearing tzitzis. In conclusion, I encourage EVERYONE to read the legislative bill in it’s entirety, and to each their own make their own determination. As I mentioned below, largely, the bill requires more transparency, openness with *ALL* fees and costs, sharing the CarFax details, and requires better protection of consumer info. My vote, I support this bill.

When one actually reads the bill (NY 4332-B), much of the legislation is aimed preventing Brokers from deceptive advertising, requires upfront pricing, requires all small-print fees to be disclosed, and mandating brokers to share details about a used car’s history (such as whether it was involved in a collision, repaired from flood waters, etc). Why in the world should I be against this? I could see why a Broker doesn’t want additional rules, but as a customer…?

the problem you don’t see is that the regulations they are adding are going to put brokers out of business

example: brokers can’t collect a commission from the dealership. but we are also now allowed to charge a broker fee to the client…

so tell me. then what is the point if we can’t make money off the deals! we are here keeping dealers on their toes. they are forced to compete with our pricing due to some of the dealerships working with us. if we can’t make money we will effectively be shut down since no one works for free…

and without brokers keeping them honest good luck and watch as dealerships go crazy raising pricing. get rid of us at your peril.

I have really loved working with my broker for car leases – the convenience alone is amazing. That said, I have read the bill (https://www.nysenate.gov/legislation/bills/2021/S4332) and don’t see anything about a “ban” on brokers. It appears to be just additional nanny-state expenses and hoops to jump through that NY loves to add on for salespeople. I’m familiar with that as my business is also impacted by similar rules. For that, and all the required disclosures, I’m not a fan of the bill. But the “ban” language makes me wonder if I misread this thing.

I have read the bill, and it in fact “bans” the leasing companies indirectly… they cannot advertise pricing on cars… they have to disclose every dollar they are earning to the customer (that is perfect capitalism… right?) etc. etc., read it and you will see

Until the recent shortages the leasing companies would get the cars from a handful of dealers who settled for a small profit and got rebates and performance awards from the manufacturers for high volumes of sales. Today the dealers can sell all the cars that they can get without the leasing companies.
In today’s market you can get better lease prices from the dealer if you are able to spend 2-3 hours haggling and watching the salesperson go back and forth to the manager. When you start walking out they will give you a better price. The last few days of the month are the best time as the salesperson wants to make sales quotas for monetary awards. If you have a current lease expiring the dealer will take your car and give you several thousand dollars off the total cost of the lease and sell your leased car for a nice profit.
I prefer buying and holding on to the car until repairs are frequent and costly usually after 8-10 years.

Both brokers and dealers are complete scammers. Everyone knows this. The fact that one side is fighting the other is no surprise. Hope they both become illegal!

Imagine if you sell appliances and if you are not a direct dealer then you are not allowed to advertise prices, not allowed a dealers commission (!), must disclose your cost and the profit margin…. On top of that you have to quote the appliance with a few different dealers and show the customer every price quote you got… If you had ever done any retail sales you know full well that you will be a failure before you even start…

This is totally against standard business practices as we know it!
